Preliminary Contract (Compromesso)

Once you have found a property you are interested in purchasing, the estate agents will ask you to proceed with the signing of the Preliminary Contract (Compromesso).

At this stage you are showing your interest in buying that specific property, signing a legal document, that actually formalises your intention in becoming the owner of the property.

In this preliminary agreement both parties (buyer and vendor) agree on the details for the Title Deed or Final Contract (Rogito) that will be signed in front of the Italian Notaio.

Some of the important elements in a Preliminary Contract are as follows: final price of the property, date for signing the Final Contract, money transfer, etc.

The estate agents are entitled at this point to ask you to pay a deposit of 10% of the property price.

Title Deed or Final Contract (Rogito)

The final step in purchasing a property in Italy is the signing of the Rogito (Title Deed or Final Contract).

This document transfers the ownership to the buyer. All the documentation for this contract is prepared and executed by the Italian Notary (Notaio) who is also in charge of carrying out all the following aspects investigations in relation to the proof of ownership from the seller, check if the property is free of debts, planning permissions and licenses, receive and transfer the documentation to the Public Land Registry, etc.

The buyer should sign all the documents in the Notary's office, however this can be done by other person with Power of Attorney.
